Effective Date: May 22, 2026  |  Last Updated: May 22, 2026

1. Acceptance of Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between you ("User," "Customer," "you," or "your") and Pequod's Pizza ("Company," "we," "us," or "our"), the operator of the website located at meal-pequods.click (the "Website"). By accessing, browsing, or using this Website — including placing orders, creating an account, or contacting us through any channel made available on the Website — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy, which is incorporated herein by reference.

If you are accessing or using this Website on behalf of a business entity, organization, or other legal person, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to both you as an individual and the entity you represent.

These Terms apply to all visitors, users, customers, and any other individuals who access or use the Website, regardless of the manner or method of access. Your continued use of the Website after any modification to these Terms constitutes your binding acceptance of such modifications.

You must be at least 18 years of age to use this Website, create an account, or place an order. By using this Website, you represent and warrant that you are 18 years of age or older. If you are under 18 years of age, you may only use the Website with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

Pequod's Pizza does not guarantee that menu items displayed on the Website will always be available. Product availability is subject to ingredient supply, kitchen capacity, and operational hours. We reserve the right to substitute ingredients or decline orders in cases of unavailability or quality concerns.

3. User Accounts and Registration

You may delete your account at any time by contacting us using the information provided in Section 14 of these Terms.

4. User Obligations and Prohibited Activities

As a condition of your use of this Website, you agree to comply with all applicable federal, state, and local laws and regulations of the United States. You agree to use the Website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit their use and enjoyment of the Website.

4.2 Prohibited Activities

You are strictly prohibited from engaging in the following activities in connection with your use of this Website:

  • Using the Website for any unlawful purpose or in violation of any applicable federal, state, or local laws, including but not limited to the Federal Trade Commission Act (FTC Act), the Computer Fraud and Abuse Act (CFAA), and applicable consumer protection statutes.

  • Engaging in any activity that could damage, disable, overburden, or impair the functioning of the Website or the servers and networks connected to it.
  • Abusing promotional offers, discount codes, or loyalty rewards programs in a manner inconsistent with their intended purpose.

We reserve the right to investigate any suspected violation of these prohibitions and take appropriate legal action, including reporting violations to law enforcement authorities, civil litigation, and/or immediate termination of your account and access privileges.

5. Ordering and Payment Terms

5.1 Order Placement and Confirmation

When you place an order through our Website, you are making an offer to purchase the selected food items. All orders are subject to acceptance and confirmation by Pequod's Pizza. We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, unavailability of items, or operational limitations.

An order is considered confirmed only when you receive an electronic order confirmation from us, typically delivered via email or displayed on the Website. Until such confirmation is issued, no contract for the purchase of food items has been formed between you and Pequod's Pizza.

5.2 Pricing

All prices displayed on the Website are in United States Dollars (USD) and are inclusive of applicable food service charges unless otherwise stated. Prices are subject to change without prior notice. Applicable sales taxes, delivery fees, and service charges will be calculated and displayed at checkout prior to your final confirmation of the order.

In the event of a pricing error on our Website, we reserve the right to cancel the affected order and issue a full refund if payment has been processed. We will notify you promptly in such cases.

5.3 Payment Methods

We accept payment through the methods indicated on the Website at the time of checkout. By submitting payment information, you represent and warrant that: (a) you are authorized to use the payment method provided; (b) the information you provide is accurate and complete; and (c) you authorize us to charge the applicable amount to your payment method.

Payment transactions are processed by third-party payment processors. We do not store complete credit card or banking information on our servers. Your use of third-party payment platforms is subject to those platforms' respective terms and privacy policies.

5.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been prepared or dispatched. However, if you receive an order that is incorrect, incomplete, or of unacceptable quality, please contact us within 24 hours of receipt at [email protected]. We will assess your concern and, at our sole discretion, offer a replacement, credit, or refund as appropriate.

Order cancellations requested before preparation has commenced may be accommodated. Once preparation has begun, cancellations and refunds cannot be guaranteed. Delivery fees may be non-refundable in certain circumstances.

6. Intellectual Property Rights

All content, materials, and features available on or through the Website — including but not limited to text, graphics, logos, images, photographs, audio clips, video content, data compilations, software, digital downloads, page design, layout, and the selection and arrangement thereof — are the exclusive property of Pequod's Pizza or its content suppliers and licensors, and are protected under applicable United States intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act (15 U.S.C. § 1051 et seq.), and related state and federal statutes.

The "Pequod's Pizza" name, logo, trade dress, and all related marks, names, slogans, and product names are trademarks or service marks of Pequod's Pizza. Nothing in these Terms grants you any right to use our trademarks, service marks, trade names, logos, or other identifying material without our express prior written consent.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or its content for commercial purposes.
  • Modify, adapt, translate, create derivative works from, or reverse engineer any content or technology on the Website.
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices affixed to or contained within the Website.
  • Frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information without our express written consent.

Any unauthorized use of the intellectual property available on this Website may give rise to claims for copyright infringement, trademark infringement, or other legal causes of action under applicable United States law. We reserve all rights not expressly granted in these Terms.

7. Third-Party Links and Services

The Website may contain links to third-party websites, platforms, and services, including but not limited to delivery partners, payment processors, social media platforms, and mapping services. These links are provided for your convenience and informational purposes only. Pequod's Pizza does not endorse, control, or assume any responsibility for the content, privacy practices, accuracy, or availability of any third-party websites or services.

Your interactions with third-party websites and services are governed solely by the terms of service and privacy policies of those third parties. We strongly encourage you to review those policies before engaging with any third-party platform. Pequod's Pizza shall not be liable for any loss or damage arising from your use of any third-party website or service linked to from our Website.

8. Disclaimers — Services Provided "As-Is"

9. Limitation of Liability

10. Indemnification

You agree to indemnify, defend, and hold harmless Pequod's Pizza, its parent companies, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, contractors, licensors, and service providers (collectively, the "Indemnified Parties") from and against any and all claims, actions, demands, losses, liabilities, damages, costs, and expenses — including reasonable attorneys' fees and court costs — arising out of or related to:

  • Your use of or access to the Website or our services.
  • Your violation of any provision of these Terms.
  • Your violation of any applicable federal, state, or local law or regulation.
  • Your violation of any third-party rights, including intellectual property rights, privacy rights, or contractual rights.
  • Any content you submit, post, or transmit through the Website.
  • Any fraudulent, deceptive, or unauthorized activity conducted through your account.
  • Any dispute between you and a third party arising from your use of the Website.

We reserve the right, at our own expense, to assume exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate fully with our defense of such claims. You shall not settle any claim without our prior written consent.

11. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to these Terms, the Website, or the services provided by Pequod's Pizza shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which Pequod's Pizza principally operates, without regard to any choice of law or conflict of law provisions.

To the extent that any legal action is permitted under these Terms (including after the dispute resolution process set forth in Section 12), you and Pequod's Pizza agree to submit exclusively to the personal jurisdiction of the state and federal courts located in the applicable jurisdiction of Pequod's Pizza's principal place of business. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

These Terms shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG), the application of which is expressly excluded. Consumer protection laws of the state of the user's residence may apply where mandated by applicable law.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first contact Pequod's Pizza informally to attempt to resolve the dispute by sending a written description of your dispute to [email protected]. We will make reasonable efforts to address your concern within 30 days of receiving your written notice. Most concerns can be resolved quickly and to your satisfaction through this informal process.

12.2 Binding Arbitration

If the parties are unable to resolve the dispute informally within 30 days, you and Pequod's Pizza agree that any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, except as otherwise provided herein. The arbitration shall be conducted in English. The arbitrator shall apply applicable substantive law consistent with the Federal Arbitration Act (FAA), 9 U.S.C. § 1 et seq., and applicable statutes of limitations.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own costs and attorneys' fees in arbitration, except where required otherwise by applicable law or the AAA's Consumer Arbitration Rules.

12.3 Class Action Waiver

YOU AND PEQUOD'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of the mandatory arbitration clause shall be null and void.

12.4 Exceptions to Arbitration

Notwithstanding the above, either party may bring an individual action in small claims court where the claim qualifies. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights.

13. Term and Termination

These Terms are effective from the moment you first access or use the Website and shall remain in full force and effect for as long as you continue to use the Website, unless terminated earlier in accordance with these Terms.

We may, in our sole discretion and without prior notice or liability, suspend or terminate your access to all or part of the Website and our services at any time for any reason, including but not limited to:

  • Your breach of any provision of these Terms.
  • Your engagement in fraudulent, illegal, or abusive conduct.
  • Extended periods of inactivity on your account.
  • Circumstances beyond our control that make continued service provision impracticable.
  • Our decision to discontinue the Website or any portion thereof.

You may terminate your use of the Website at any time by ceasing all use and, if applicable, deleting your account by contacting us at [email protected]. Any outstanding payment obligations or order commitments will survive termination.

Upon termination, your right to access and use the Website and its services shall immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 11 (Governing Law), 12 (Dispute Resolution), and 14 (Contact Information).

14. Changes to These Terms

Pequod's Pizza reserves the right to modify, update, revise, or replace these Terms at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and may notify registered users by email or through a prominent notice on the Website.

Your continued access to or use of the Website following the posting of revised Terms constitutes your acceptance of and agreement to those changes. If you do not agree to the revised Terms, you must discontinue your use of the Website immediately.

We encourage you to review these Terms periodically to stay informed of any updates. The most current version of these Terms will always be available at meal-pequods.click.

15. Severability

If any provision of these Terms is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect as if the invalid or unenforceable provision had never been included in these Terms.

The parties agree that any such invalid or unenforceable provision shall be replaced by a valid, enforceable provision that most closely approximates the intent and economic effect of the original provision. No waiver of any provision of these Terms shall be effective unless made in writing and signed by an authorized representative of Pequod's Pizza.

16. Entire Agreement and Waiver

These Terms, together with our Privacy Policy and any other legal notices published by Pequod's Pizza on the Website, constitute the entire agreement between you and Pequod's Pizza with respect to your use of the Website and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the subject matter hereof.

The failure of Pequod's Pizza to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision of these Terms shall be effective only if it is in writing and signed by an authorized representative of Pequod's Pizza, and shall not constitute a waiver of any future or continuing right or obligation.

No agency, partnership, joint venture, employment, or franchise relationship is created between you and Pequod's Pizza as a result of these Terms or your use of the Website.

17. Force Majeure

Pequod's Pizza shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by events or circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, governmental actions or regulations, labor disputes, power outages, internet or telecommunications failures, supply chain disruptions, civil unrest, or acts of terrorism. In such circumstances, our obligations will be suspended for the duration of the force majeure event, and we will use commercially reasonable efforts to resume normal operations as soon as practicable.

18. California Consumer Rights Notice

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as well as other California consumer protection statutes. These rights may include the right to know about personal information collected, the right to delete personal information, the right to opt-out of the sale or sharing of personal information, and the right to non-discrimination for exercising your privacy rights.
